Akkio Inc. (“Akkio,” “we,” and/or “us”) values the privacy of the individuals who use our website and related services that link to this privacy policy (“Privacy Policy”) (collectively, the “Service”). This Privacy Policy explains how we collect, use and share information from users of our Service (“you”). By using our Service, you agree to the collection, use, disclosure, and procedures this Privacy Policy describes. In addition to the Privacy Policy, your use of our Service is subject to our Website Terms of Service (akkio.com/terms).

Information We Collect

We may collect a variety of information from or about you or your devices from various sources, as described below.

Information You Provide to Us

Registration. When you register for an account, we may ask for information, such as your name, company, email, username and password.

  • Payment and Billing Information. Financial information in connection with billing including, without limitation, billing information and address.

Your Data. When you use the portion of our Service that is designed to enable users to create AI models, we collect any data sets or content that you submit to us so we can provide you with AI models.

Communications. If you contact us directly, we may receive additional information about you. For example, if you email our support team, we will receive information such as your name, email address, the contents of your message, any attachments you may send to us, and any other information you choose to provide. You also will provide us with certain information when you sign up to receive updates about our business, including through newsletters.  

Information We Collect When You Use Our Service

Information from Cookies and Similar Technologies. We collect information using cookies, pixel tags, or similar technologies. Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to our Service. Please review your web browser’s “Help” file to learn the proper way to modify your cookie settings. Please note that if you delete or choose not to accept cookies from the Service, you may not be able to use the features of the Service to their fullest potential.

Device Information. We receive information about the device and software you use to access our Service, including your internet protocol (IP) address, web browser type, operating system version, phone carrier and manufacturer, device identifiers, and mobile advertising identifiers.

Usage Information. To help us understand how you use our Service and to help us improve them, we automatically receive information about your interactions with our Service, such as the pages or other content you view, the searches you conduct, and the dates and times of your visits.

How We Use the Information We Collect

We use the information we collect:

  • To operate, maintain, enhance and provide features of the Service, including to train and improve any underlying algorithms or models that power our technology, provided that Google Workspace APIs are not used to develop, improve, or train generalized AI and/or ML models (more information here);
  • To understand and analyze how you use our Service and develop new products, Service, features, and functionality;
  • To communicate with you, provide you with updates and other information relating to our Service, provide information that you request, respond to comments and questions, and otherwise provide user support;
  • For marketing and advertising purposes, such as developing and providing promotional and advertising materials that may be relevant, valuable, or otherwise of interest to you;
  • To find and prevent fraud and respond to trust and safety issues that may arise;
  • For compliance purposes, including enforcing our Website Terms of Service or other legal rights or contracts that we may enter into, or as may be required by applicable laws and regulations or requested by any judicial process or government agency; and
  • For other purposes for which we provide specific notice at the time the information is collected.
  • We do not sell to any third party the information we receive or collect from you. 

How We Share the Information We Collect

We may share information we receive from or about you or your devices as described below.

Analytics Partners. We use analytics services such as Plausible and Google Analytics to collect and process certain analytics data. Google Analytics may also collect information about your use of other websites, apps, and online resources. You can learn about Google’s practices by going to https://www.google.com/policies/privacy/partners/, and opt-out of them by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout

Vendors and Service Providers. We may share any information we receive with vendors and service providers retained in connection with the provision of our Service, including to vendors for the purpose of improving our future marketing efforts. Our use and transfer of information received from Google APIs, including to any other app, will adhere to Google API Services User Data Policy, including the Limited Use requirements.

As Required by Law and Similar Disclosures. We may access, preserve, and disclose your information if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal process, such as a court order or subpoena; (b) respond to your requests; or (c) protect your, our, or others’ rights, property, or safety.

Merger, Sale, or Other Asset Transfers. We may transfer your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our assets. The use of your information following any of these events will be governed by the provisions of this Privacy Policy in effect at the time the applicable information was collected.

Consent. We may also disclose your information with your permission.

Third Parties

The Service allows you to, upon your direction, export information to third party services. We are not responsible for the practices of these third parties. Please be aware that this Privacy Policy does not apply to your activities on these third party services or any information you disclose to these third parties. We encourage you to read their privacy policies before providing any information to them.

Security

We make reasonable efforts to protect your information by using safeguards designed to improve the security of the information we maintain. However, as no electronic transmission or storage of information can be entirely secure, we can make no guarantees as to the security or privacy of your information.

Children

We do not knowingly collect, maintain, or use personal information from children under 13 years of age, and no part of our Service is directed to children. If you learn that a child has provided us with personal information in violation of this Privacy Policy, then you may alert us at legal@akkio.com.

Privacy Rights

You may have privacy rights regarding your personal information.

• You may request a copy of your personal information or request to correct, update, or delete your personal information.

• You may request that we disclose what personal information we collect, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, and the categories of third parties to whom we disclose personal information.

• Where required by law, you can object to processing of your personal information, ask us to restrict processing of your personal information, or request portability of your personal information.

• If we collected and processed your personal information with your consent, where required by law, you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

• Californians also have the right to opt out of the sale of personal information or the sharing of personal information for cross-context behavioral advertising, as well as the right to limit the use or disclosure of sensitive personal information for purposes other than those permitted by the CCPA if sensitive personal information is collected. As described above, we do not sell your personal information, or use or disclose sensitive personal information for purposes other than those permitted by the CCPA. You may opt-out of the sharing of personal information in the Cookie Settings. You can submit a request by emailing legal@akkio.com.

Akkio will verify that the information you submit (which may include your first name, last name, email address, company, and country/state) matches our records before we fulfill the request. You may use an authorized agent to submit a consumer rights request on your behalf using the methods above, however, Akkio will require the authorized agent to provide signed permission to submit the request on your behalf and may still contact you to confirm your identity and that this request was submitted with your permission.

International Transfers of Data

Our Service is hosted in the United States. If you choose to use our Service from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the United States for storage and processing. Also, we may transfer your data from the U.S. to other countries or regions in connection with the storage and processing of data, fulfilling your requests, and operating the Service. By providing any information, including personal information, on or to the Service, you consent to such transfer, storage, and processing.

European Economic Area and United Kingdom Disclosure

If you are located in the European Economic Area or the United Kingdom, please review this additional information. Please note that Akkio is the controller of the personal information you submit to create and administer your account (typically, name and email address).

Legal Basis for Processing

When we process your personal information, we will only do so when we have a valid “legal basis”, including as set forth below:

  • Consent. We have your consent to do so. For example, we may ask for your consent to use non-essential cookies. 
  • Contractual Necessity. We need to use your personal information to perform our responsibilities under our contract with you (e.g., processing payments for and providing the Service).
  • Legitimate Interests. We or a third party have a legitimate interest in processing your personal information. For example, we may process your personal information to communicate with you about changes to the Service, and to provide, secure, and improve the Service. We only rely on this legal basis when our or a third party’s legitimate interests are not overridden by your rights and interests.
  • Compliance with a Legal Obligation. We have a legal obligation to use your personal information, for example to comply with tax and accounting obligations. 

Your Rights

You have certain rights and protections regarding the processing of your personal information. Unless otherwise provided under applicable law, you have the following rights:

  • Access and Portability. You may ask us to provide you with a copy of the personal information we maintain about you, including a machine-readable copy of the personal information that you have directly provided to us, and request information about its processing.
  • Rectification and Deletion. You may ask us to update and correct inaccuracies in your personal information, or to have the information anonymized or deleted, as appropriate.
  • Restriction and Objection. You may ask us to restrict the processing of your personal information, or object to such processing.
  • Consent Withdrawal. You may withdraw any consent you previously provided to us regarding the processing of your personal information, at any time and free of charge. We will apply your preferences going forward and this will not affect the lawfulness of the processing before you withdraw your consent.

You may exercise your rights by following the instructions under “Privacy Rights” above, or by contacting us using the contact details at the end of this Policy. Before fulfilling your request, we may ask you to provide reasonable information to verify your identity. Please note that there are exceptions and limitations to each of these rights, and that while any changes you make will be reflected in active user databases instantly or within a reasonable period of time, we may retain personal information for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so. In addition, certain choices may make it impossible to provide our Service. For instance, if you ask us to delete all your personal information and no exception applies, we will no longer be able to provide the Service since certain personal information, such as an email address, are required to provide the Service. We will inform you when you will need to permanently delete your account in order to satisfy a request you have made. 

Questions or Complaints 

If you are located in the EEA or the UK and have a concern about our processing of personal information, you have the right to lodge a complaint with a supervisory authority, including in your country of residence, place of work, or where an incident took place.

Changes to the Privacy Policy

We will post any adjustments to the Privacy Policy on this page, and the revised version will be effective when it is posted. If we materially change the ways in which we use or share personal information previously collected from you through the Service, we will notify you through the Service, by email, or other communication.
